Paper binders are slowly dying out, and virtual tenant files are taking their place. Agreements, protocols, billing, correspondence &#8211; all in one system. Sounds great, doesn&#8217;t it? Well, exactly &#8211; but simply going digital doesn&#8217;t settle the matter. A poorly kept file &#8211; even a digital one &#8211; generates real losses. Disputes over deposits, administrative fines, chaos in utility billing. I&#8217;ve seen it dozens of times. And what&#8217;s interesting is that even experienced landlords fall into the same traps. Below I describe six mistakes that cost real money. And by far the most common. A handover protocol with the description &#8220;flat in good condition&#8221; is no proof at all. None. In a dispute with a tenant, a document like that is worthless. And no photos when you hand over the keys? That&#8217;s surrendering your weapon before the fight even starts. Renovating a bathroom or replacing the flooring after a careless tenant &#8211; we&#8217;re talking thousands of zloty that the landlord covers out of their own pocket.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 675 \u00a7 1 of the Civil Code states it clearly &#8211; once the agreement ends, the tenant returns the unit in a condition that is not impaired. But they are not liable for normal wear and tear. In practice? Slightly dirty walls, minor scratches on the panels &#8211; that falls within the norm. But a smashed window, a wrecked shower cubicle, holes in the kitchen worktop &#8211; that&#8217;s a completely different story. Except that without solid documentation you won&#8217;t prove that this damage occurred during the tenancy. And that&#8217;s it. End of discussion.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;It&#8217;s best for the parties to take photographic documentation of the unit, so that when it&#8217;s handed back &#8211; for example after a year &#8211; there&#8217;s no doubt as to whether any damage and wear is the tenant&#8217;s responsibility or whether it was already there beforehand.&#8221; &#8211; Pewny Lokal<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A good digital handover protocol must include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Photos of every room with an automatic date and time stamp<\/li>\n<li>A detailed description of the furnishings, noting the technical condition of each item<\/li>\n<li>Readings from all meters &#8211; water, electricity, gas &#8211; together with their serial numbers<\/li>\n<li>A list of existing faults and damage with their exact location<\/li>\n<li>Electronic signatures from both parties confirming that the description matches the actual condition<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Tip:<\/strong> Set up a protocol template in your SaaS system with ready-made fields for each room. Automatically attaching photos with a time stamp and geolocation? That nips any attempt to challenge the documentation in the bud. I know the feeling. With one flat you somehow manage. But with three, five? You lose track of which version of the agreement applies to which tenant. Because every addendum changes the terms, and suddenly you have three versions of the same document in three different places.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The problems surface during disputes &#8211; and disputes in renting aren&#8217;t a matter of &#8220;if&#8221;, only &#8220;when&#8221;. An overlooked addendum changing the rent leads to incorrect billing. The lack of an up-to-date agreement makes your case in court harder. And a lost message in which the tenant reported a leaking tap? It can be used against you as evidence that you ignored the fault. Each of these situations is a concrete cost &#8211; legal, financial or reputational.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution? One place for everything. Seriously, that&#8217;s all it takes. SaaS platforms let you generate agreements, addenda, protocols and invoices straight from the app. The documents land in the tenant file automatically. File versioning &#8211; you can see who changed what and when. Digital signatures &#8211; legal force without printing and scanning. All the correspondence &#8211; arrangements, consents, changes to terms &#8211; chronologically, searchable, in one place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An organised system pays for itself with the first dispute you avoided because you found the right document in three seconds. With a portfolio of more than three units, juggling files by hand is simply a waste of time. Gas inspection &#8211; every year. Chimney sweep inspection &#8211; every year. Electrical inspection &#8211; every five years. Miss any one of them? Legal and financial liability. And in the worst-case scenario &#8211; no up-to-date inspection, and the insurer refuses to pay out. Imagine flooding the neighbour below, damage running to tens of thousands, and no policy to cover it.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;Since 28 April 2023, there has been a requirement to provide the tenant with an energy performance certificate. Failing to provide this document may result in a fine of up to 5000 z\u0142.&#8221; &#8211; a source on landlords&#8217; obligations 2026<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The energy performance certificate &#8211; a huge number of landlords forget about it. It applies both to whole flats and to rooms let out. A fine of up to 5000 z\u0142 for not having this document. And all it takes is to commission it from a certified auditor and drop it into the file. Nothing complicated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Insurance is a separate matter. An expired policy left unrenewed means the full risk sits with you. Flooding, fire, hail &#8211; whatever happens, you pay out of your own pocket. The cost of repairs after such events is many times the annual premium. Monitoring policy expiry dates is an absolute basic when managing your unit files.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Tip:<\/strong> Set up automatic reminders 30 and 7 days before each document expires &#8211; the energy performance certificate, the insurance policy, the inspection reports. Two alerts give you enough time to order a new inspection or renew the insurance. Even with a dozen or so units, nothing will slip past you.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Settling_utilities_by_hand_instead_of_automating\"><\/span>Settling utilities by hand instead of automating<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Excel for utility billing. Or worse &#8211; pen and paper. With one flat you can manage it (though it takes discipline). With three, five? That&#8217;s asking for trouble. Every error in calculating water, electricity or heating undermines the tenant&#8217;s trust. And then come the emails, the explanations, the grievances. A waste of time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It gets hardest with tenant turnover. Shortening the billing periods with providers is sometimes impossible. You&#8217;re left calculating the proportional costs from meter readings yourself. By hand. Underestimate the advance payments &#8211; you lose money. Overestimate them &#8211; the tenant gets annoyed. There&#8217;s no good way out here without automation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Typical slip-ups with manual billing:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Mixed-up meter readings between units or billing periods<\/li>\n<li>No consumption history, making it impossible to verify unusual bills<\/li>\n<li>Unsettled transition periods when changing tenants<\/li>\n<li>Failure to issue invoices for tenants running a business<\/li>\n<li>Skipping the adjustment of advance payments despite rising provider rates<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">SaaS systems with a billing module and KSeF integration do it for you &#8211; e-invoices, consumption history, flagging of anomalies. The cost? From 9.84 PLN per unit per month in the basic package. With five units that&#8217;s under 50 zloty. The price of two coffees in central Warsaw. A tenant file is a treasure trove of sensitive data &#8211; PESEL number, a copy of the ID card, proof of earnings, contact details, information about the family. Storing all that without proper safeguards? GDPR exists for a reason. And the penalties for not complying with it are very real.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An agreement with a landlord who runs a business must include information about the processing of personal data. But the obligation also applies to private landlords who let out regularly. An information clause &#8211; the purpose of processing, the retention period, the tenant&#8217;s rights. Without it you&#8217;re breaching the rules, and the UODO (the Polish data protection authority) can send you a bill for that breach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And here&#8217;s a difference that many people play down &#8211; a folder on your computer&#8217;s desktop (even a password-protected one) is not the same as a dedicated system with access control. A folder doesn&#8217;t log operations. You don&#8217;t know who viewed a tenant&#8217;s data, or when. You can&#8217;t set different permission levels &#8211; and that becomes important when you work with a property manager or an accountant. A SaaS platform records every action, lets you grant granular permissions, and encrypts the data at every stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A leak of tenants&#8217; data isn&#8217;t just penalties. It&#8217;s a loss of reputation. Word that a landlord doesn&#8217;t care about data security spreads fast. Agreements, protocols, billing, correspondence &#8211; it all disappears. Recreating some of those documents is simply impossible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The scale of the risk grows with the number of units. With one flat &#8211; a nasty situation, but manageable. With ten, twenty? A drive failure without a backup paralyses your entire operation. You can&#8217;t pursue claims without the agreements. You won&#8217;t recreate the utility billing history without hours poring over the providers&#8217; invoices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ransomware &#8211; that&#8217;s a scenario I&#8217;m seeing more and more often. Cybercriminals encrypt your data and demand a ransom. Property owners rarely have advanced IT security. An easy target. And paying the ransom? No guarantee of getting your files back. Without a backup, you&#8217;re left with nothing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What to do? Automatic cloud backups &#8211; daily, without any input from you. Encryption of data both in transit and at rest. And recovery tests &#8211; at least once a quarter, check that the backup actually works (because a backup you don&#8217;t test isn&#8217;t a backup). Professional SaaS systems do this automatically. Technical inspections &#8211; according to the statutory calendar: the gas and chimney installations every year, the electrical one every five years.
