Want to know when the tenancy will end? Then go for a fixed-term lease agreement. It expires on its own, on the date written in the contract. No notice, no need to find grounds. The indefinite option gives you more freedom, but to end it someone has to give notice, and the landlord can’t do that for just any reason. I’m writing this for someone who owns one or two flats and is signing their first lease. An indefinite lease runs until one of the parties terminates it. In the first case, both sides know the end date from day one. In the second, there simply is no end until someone gives notice and waits out the notice period. Both options are covered by the Civil Code rules on leases. But with flats, that’s not the whole story. There are also tenant protection laws, and they seriously limit the landlord’s right to terminate.

Fixed-term or indefinite lease: comparison table

The differences are easiest to see when you put both options side by side, point by point.

Criterion

Fixed term

Indefinite term

How it ends

Expires on the date set in the contract

By notice or by mutual agreement

Termination by the landlord

Only in the cases listed in the contract

Only on grounds allowed by tenant protection laws

Termination by the tenant

Only in the cases listed in the contract

At any time, with the notice period observed

Predictability for the owner

High, the end date is known

Low, the end depends on the parties’ decisions

Flexibility when plans change

Low for both parties

High, especially for the tenant

Rent changes during the lease

As set in the contract or by an annex

Possible, but within tenant protection laws

Risk of turning into an indefinite lease

Yes, without written form or with tacit extension

Not applicable

In short: when it comes to ending the tenancy, the owner holds more cards with a fixed-term lease.

Terminating a fixed-term lease: when is it possible at all

Only in the situations written into the contract when it was signed. That’s why you need to list them specifically, not in vague terms. And if the contract says nothing? Then you’re left with mutual agreement or waiting for the end date. That’s it. In my view, it’s worth adding clauses like these right away:

arrears in rent or other charges,

using the flat against the contract or damaging it,

subletting or handing the flat over to someone else without the owner’s consent,

persistently breaking the house rules.

I wouldn’t count on a clause allowing termination “for any reason”. Such a broad clause can be challenged in a dispute, so it’s better to have a lawyer check the final wording. And for the moment you part ways, you’ll find this article on notice periods and form useful.

Indefinite lease agreement: what you gain and what you lose

Here the parties can part ways without waiting for the term to run out. The catch is that the owner can’t terminate for just any reason. The tenant has it much easier: all they need to do is keep to the notice period.

The upside? You don’t have to renew the contract every so often, which works nicely with a reliable tenant who stays for years. The downside is less control over the end date. The tenant moves out whenever it suits them, while you need grounds under the law. Uneven? Exactly. In borderline cases (for example, when you want the flat back for your own use), talk to a lawyer before you send anything.

One-year lease: traps in form and extension after the term

For a first rental, people most often sign a one-year lease. And here two things can quietly turn it into an indefinite one. The first is the lack of written form: a lease concluded for more than a year without a written document is treated as concluded for an indefinite term. The second is silence after the end date. The tenant keeps living there, keeps paying, and you don’t object? The tenancy may be extended with no end date.

Hence a simple rule: always put the lease in writing, with a start and end date. And make a decision before the term runs out. An annex with a new date, a new contract or a clear end to the tenancy with a handover report. In Tenanto, reminders about expiring leases and lease statuses help you not miss that moment, and annexes and reports are kept in one place together with the contract.

When to choose which option: advice for a single-flat owner

Want control over when the tenancy ends? Go fixed-term. Consider an indefinite lease only with a tenant you already know. In practice, typical situations look roughly like this:

You plan to sell or renovate: fixed term, with an end date before those plans.

You’re renting to a stranger for the first time: fixed term, with clearly written grounds for termination.

You have a long-term, reliable tenant: an indefinite lease will save you both more annexes.

You want stronger protection in case of eviction: consider an occasional lease (najem okazjonalny).

An occasional lease means more paperwork, no point hiding it. The article on how an occasional lease differs will help you judge whether it’s worth the effort. You’ll find more topics in the section with articles on rental management.

To start with, I recommend a fixed-term lease agreement. In writing, with a specific end date and precisely listed grounds for termination. Such a contract saves you surprises, and you can always switch to an indefinite one later.

Frequently asked questions

Can a fixed-term lease be terminated before the end date?
Yes, but only in the cases set out in the contract itself. That’s why you need to decide something before the end date: an annex, a new contract or ending the tenancy. And put it in writing.

Can a fixed-term lease be converted into an indefinite one?
Yes, by an annex or a new contract signed by both parties. While you’re at it, rethink the termination rules, because they work differently in an indefinite lease. Keep the new document together with the original contract.

Fixed-term or indefinite lease agreement?
