It only confirms where someone is staying. It is not the landlord&#8217;s decision and it does not give anyone a legal title to the flat. The documents you need to file are set by the municipal office, so that is the best place to ask about your own situation. Many landlords worry that a registry entry will make it harder to get the flat back after the tenancy ends. There is no need to worry. The tenant goes there with a document confirming the right to occupy the flat, for example the <strong>lease agreement<\/strong>. The office provides the full list of required papers. And what about refusing to sign? It does not protect the flat, because registration gives the tenant no extra rights anyway. In my view, a dispute over a formality is not worth the stress. It is better to put the effort into a lease that clearly sets out the rental period and the move-out rules.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Temporary_residence_registration_for_renting_vs_permanent_residence\"><\/span>Temporary residence registration for renting vs permanent residence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">With a fixed-term lease, temporary residence registration is the most common choice, and its period is stated when filing at the office. Permanent residence is the place where someone lives with the intention of staying there permanently. Temporary residence? Staying at an address for a set time, without that intention. But note (landlords often get this wrong): neither option gives the tenant a right to the flat after the lease expires. A municipal office clerk will help you fill in the form and choose the type of residence for a specific case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_protect_your_flat_before_the_tenant_registers\"><\/span>How to protect your flat before the tenant registers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Real protection comes from the lease and proper tenant screening, not from watching over the registration. Before signing, it is worth checking <a href=\"https:\/\/tenanto.pl\/en\/tenant-screening-gdpr-what-you-may-check\/\">what you may check about tenants<\/a>, so you don&#8217;t run into data protection rules. Your documents should include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>full details of the tenant and everyone who will live in the flat,<\/li>\n<li>a clearly defined rental period and termination rules,<\/li>\n<li>an address for correspondence after moving out,<\/li>\n<li>a handover report describing the condition of the flat and its furnishings,<\/li>\n<li>copies of all annexes signed during the tenancy.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Want stronger protection? Then:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Collect documents confirming that the flat has been vacated, for example the handover report and the lease termination notice.<\/li>\n<li>File a deregistration request at the municipal office.<\/li>\n<li>Respond to the office&#8217;s requests and provide any documents it asks for.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Administrative deregistration is handled by the office. It&#8217;s a different story when the tenant is still living in the flat. The safety of your flat depends on the lease and good paperwork, and that is the mindset to bring to the conversation. You can always confirm the list of required documents at the municipal office.
