What counts is the cause of the leak and what the lease says. Who happens to live in the apartment matters much less. It usually starts the same way. The downstairs neighbor calls about a water stain on their ceiling, and the tenant swears they didn&#8217;t touch anything. So what now? Every minute of delay means more damage downstairs and a harder fight about money later on.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Turn off the main water valve in the apartment. No access to it? Ask the building manager.<\/li>\n<li>If the water could reach sockets or light fittings, cut the power in the flooded part of the apartment.<\/li>\n<li>Call the tenant and ask them to let you in right away.<\/li>\n<li>Notify the building manager or administration if the leak may be coming from the riser or you can&#8217;t find its source in the apartment.<\/li>\n<li>Take photos and videos of the leak&#8217;s source and of the damage at the neighbor&#8217;s before anyone repairs or dries anything.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">One more thing. Don&#8217;t admit fault or promise to pay at this point. Until you know what happened, words like that can seriously complicate your conversation with the insurer later.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tenant_flooding_and_the_cause_of_the_leak_who_pays_in_typical_cases\"><\/span>Tenant flooding and the cause of the leak: who pays in typical cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Who covers the damage? It comes down to where the failure happened and why. That&#8217;s it. This is the question people ask most often: the apartment got flooded, so who pays, the tenant or the landlord? I&#8217;ve put the typical cases in a table.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table>\n<thead>\n<tr><th>Cause of the leak<\/th><th>Who is usually responsible<\/th><\/tr>\n<\/thead>\n<tbody>\n<tr><td>The tenant&#8217;s own equipment or negligence: their washing machine, dishwasher, a tap left running<\/td><td>Usually the tenant<\/td><\/tr>\n<tr><td>Plumbing in the apartment: a worn faucet hose, a valve, a radiator that belongs to the apartment<\/td><td>Usually the landlord, unless the lease or the tenant&#8217;s negligence points elsewhere<\/td><\/tr>\n<tr><td>The riser and the building&#8217;s shared plumbing<\/td><td>The building manager or the housing community<\/td><\/tr>\n<\/tbody>\n<\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The general rules of liability for damage are in the <a href=\"https:\/\/dziennikustaw.gov.pl\/DU\/2026\/795\" rel=\"nofollow\">consolidated text of the Polish Civil Code<\/a>. But to be honest, that text won&#8217;t settle your specific case. When the parties disagree about the cause or who is at fault, it&#8217;s better to talk to a lawyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Water_damage_report_what_to_include\"><\/span>Water damage report: what to include<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A water damage report is a joint description of the incident, signed by the people present on site. It goes to the insurer, and every conversation about costs starts with it. What should it include?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the date and time of the incident and of the inspection,<\/li>\n<li>the location and likely source of the leak,<\/li>\n<li>a description of the damage in both apartments,<\/li>\n<li>a list of the people present,<\/li>\n<li>photos as an attachment,<\/li>\n<li>comments from the tenant and the neighbor if they disagree with the description.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In my view, someone from the building manager should attend the inspection, especially if the riser may be involved. Keep the report and photos in one place with the lease and its annexes (a year from now nobody will remember where they are). Whether it pays out is the insurer&#8217;s decision, made under the policy terms. So don&#8217;t assume that <strong>tenant liability insurance<\/strong> or your own policy will cover everything. Go through the general terms and conditions: the scope of cover, the exclusions, the deadline for reporting a claim. Boring, I know. But necessary. Check the lease as well, because many landlords require tenants to have personal liability insurance. Find out before you sit down to talk with the neighbor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_does_the_lease_say_about_repairs_and_damage\"><\/span>What does the lease say about repairs and damage?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Most leases split the duties like this: minor repairs and routine maintenance fall to the tenant, while plumbing and replacing appliances fall to the landlord. After a flood, read the clauses on reporting faults and on liability for equipment the tenant brought in. A clear <a href=\"https:\/\/tenanto.pl\/en\/minor-repairs-who-pays-rental-agreement\/\">split of repair costs in the lease<\/a> cuts a lot of arguments short, because you can see straight away whose hose it was and whose valve. Then there&#8217;s how fast faults get reported. If the tenant can report a fault on the spot, for example in the tenant portal, a leaking hose gets noticed before the water reaches the floor below.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_you_deduct_the_damage_from_the_tenants_deposit\"><\/span>Can you deduct the damage from the tenant&#8217;s deposit?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You can, but only if the tenant is responsible for the damage and you can prove it. This usually happens when you settle up at the end of the tenancy. You can&#8217;t do it without evidence: the report, photos and findings on the cause, ideally confirmed by the building manager or the insurer. It&#8217;s worth knowing the rules behind <a href=\"https:\/\/tenanto.pl\/en\/security-deposit-when-to-keep-when-to-return\/\">deducting damage from the deposit<\/a> before you talk to the tenant. And if you&#8217;re still arguing about who is at fault? Don&#8217;t make the deduction on your own. Regular inspections, plus a tenant who knows what to do when something leaks. Every time a tenant changes, check the hoses, valves and washing machine and dishwasher connections, and record any replacement in the repair history. Also show the tenant where the main water valve is. Seriously, it takes five minutes and saves waiting for you when things go wrong.
