The scenario is usually the same. The building manager or a neighbor calls to complain about noise and late-night parties, and the tenant says someone is exaggerating. So what now? You don&#8217;t have to take sides right away. So start by checking what is actually happening. Ask the person reporting it for specifics: when it was loud, for how long, whether it happens regularly and who else heard it. Then talk to the tenant and hear their side (sometimes the dispute goes back years, longer than the tenancy itself, or it is about a different apartment altogether). Don&#8217;t take a position after a single phone call. In practice, a calm conversation often settles things faster than any letter.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_do_you_document_neighbor_complaints_about_a_tenant\"><\/span>How do you document neighbor complaints about a tenant?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Documentation means dates, a description of events and the source of each complaint. Write it down as things happen, not from memory six months later, when nobody remembers whether the party was on a Tuesday or a Saturday. What should you collect?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>written complaints from neighbors, ideally dated and signed,<\/li>\n<li>letters and emails from the building manager or housing community,<\/li>\n<li>your own notes: date, time, description of the incident, who reported it,<\/li>\n<li>correspondence with the tenant, including their replies and explanations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Your point of reference is the housing community&#8217;s rules or the house rules in force in the building, plus the terms of the lease. It is easier to keep all the messages in one place. In Tenanto, the <a href=\"https:\/\/tenanto.pl\/en\/features\/\">communication history with the tenant<\/a> and your stored documents form a clear record you can go back to if the dispute drags on.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Written_warning_why_it_is_mandatory_and_what_to_include\"><\/span>Written warning: why it is mandatory and what to include<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When you rent an apartment to a private individual, a <strong>written warning to the tenant<\/strong> is a condition for later terminating the lease for breaching the house rules. You can&#8217;t skip it. This follows from Art. 11(2)(1) of the <a href=\"https:\/\/dziennikustaw.gov.pl\/DU\/2023\/725\" rel=\"nofollow\">Polish Act on the Protection of Tenants&#8217; Rights<\/a>, which only allows termination if the tenant keeps behaving the same way despite such a warning. A good warning includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a description of specific behavior with dates, not generalities,<\/li>\n<li>a reference to the lease and the house rules,<\/li>\n<li>a demand to stop the violations,<\/li>\n<li>delivery you can prove, for example by registered mail with acknowledgment of receipt.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">What if the problem is a dog that barks all day? Then refer to the <a href=\"https:\/\/tenanto.pl\/en\/renting-apartment-with-pets-lease-clauses\/\">pet rules in the lease<\/a> that both parties agreed on when signing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_does_persistent_breach_of_house_rules_justify_terminating_the_lease\"><\/span>When does persistent breach of house rules justify terminating the lease?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Terminating a lease for disruptive behavior becomes an option when the tenant, despite a written warning, grossly or persistently breaches the house rules and makes it hard for others to use their apartments in the building. Under Art. 11(1) of that Act, the owner may terminate the lease only for the reasons listed there, in writing (otherwise it is void) and stating the reason. That is why it pays to know the requirements for <a href=\"https:\/\/tenanto.pl\/en\/ending-a-tenancy-notice-periods-form-mistakes\/\">written notice stating the reason<\/a>. The notice period? At least one month, effective at the end of a calendar month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 685 of the <a href=\"https:\/\/dziennikustaw.gov.pl\/DU\/2026\/795\" rel=\"nofollow\">consolidated text of the Polish Civil Code<\/a> is a general provision on leases. For a residential tenant, it does not override the requirements of the Act on the Protection of Tenants&#8217; Rights, which many people forget. In borderline cases, such as one loud evening or feuding neighbor families, I think it is better to talk to a lawyer before the letter goes out.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Escalation_steps_from_conversation_to_termination\"><\/span>Escalation steps: from conversation to termination<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You move from a conversation, through a letter, to termination. Each stage leaves a paper trail:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Talk to the tenant and establish the facts.<\/li>\n<li>Collect written complaints from neighbors and the building manager.<\/li>\n<li>Send a written warning describing the behavior and demanding that it stop.<\/li>\n<li>Watch whether the behavior has stopped and keep recording reports.<\/li>\n<li>Serve written notice stating the reason and observing the notice period.<\/li>\n<li>If the tenant does not leave the apartment, go to court.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">We cover the last step in our article on how <a href=\"https:\/\/tenanto.pl\/en\/evicting-a-tenant-when-possible-how-it-works\/\">eviction after valid termination<\/a> works. An occasional lease (najem okazjonalny) has its own separate procedure for vacating the apartment, discussed in the article on <a href=\"https:\/\/tenanto.pl\/en\/occasional-lease-in-practice-what-it-solves\/\">enforcement under an occasional lease<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_not_to_do_even_when_the_tenant_disturbs_the_peace\"><\/span>What not to do, even when the tenant disturbs the peace<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Self-help hurts the owner. It weakens your position in any later dispute and hands the tenant arguments. So even when your patience runs out:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>don&#8217;t cut off electricity, water or gas,<\/li>\n<li>don&#8217;t change the locks,<\/li>\n<li>don&#8217;t enter the apartment without the tenant&#8217;s consent,<\/li>\n<li>don&#8217;t remove their belongings.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Before you go to check things on site, see <a href=\"https:\/\/tenanto.pl\/en\/landlord-entry-rented-apartment-when-allowed\/\">when the owner may enter<\/a> a rented apartment. Also, don&#8217;t send the termination notice by email or text message, and don&#8217;t leave out the reason. Such a notice will not meet the requirements of the Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_talk_to_neighbors_and_the_housing_community_during_a_dispute\"><\/span>How to talk to neighbors and the housing community during a dispute<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Neighbors and the building manager are your source of evidence. Ask them for complaints in writing, with dates and a short description of what happened. Complaints made over the phone are hard to use later, while a signed report from several people carries much more weight. Tell the housing community what steps you have taken, but don&#8217;t share the tenant&#8217;s personal data or lease details beyond what is necessary. A matter-of-fact tone with both sides also protects you, because the conflict can easily shift onto the owner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a problem tenant appears, stick to a fixed order: facts and documents first, then a written warning, and only if the violations continue, termination in line with the Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Frequently_asked_questions\"><\/span>Frequently asked questions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"schema-faq wp-block-yoast-faq-block\"><div class=\"schema-faq-section\" id=\"faq-question-1790340894781-0\"><strong class=\"schema-faq-question\">Can I terminate the lease after one party?<\/strong> <p class=\"schema-faq-answer\">Usually not. The Act requires gross or persistent behavior, preceded by a written warning after which the tenant keeps breaching the house rules. One party is a good reason for a warning. Not really for termination.<\/p> <\/div><div class=\"schema-faq-section\" id=\"faq-question-1790340894781-1\"><strong class=\"schema-faq-question\">Is a neighbor&#8217;s complaint enough as evidence?<\/strong> <p class=\"schema-faq-answer\">It helps, but on its own it can be weak. It is better to have several dated written reports, letters from the building manager and your own correspondence with the tenant. Only a set like that shows the problem keeps coming back.<\/p> <\/div><div class=\"schema-faq-section\" id=\"faq-question-1790340894781-2\"><strong class=\"schema-faq-question\">What if the tenant doesn&#8217;t move out after termination?<\/strong> <p class=\"schema-faq-answer\">The owner does not remove the tenant on their own. The only route is through the courts.
