A portable unit that does not interfere with the premises is simply ordinary use of the flat. Installation with drilling and an outdoor unit is a different story: it is a change that the owner has to agree to, and where the facade is involved, often the homeowners&#8217; association or housing cooperative as well. August 2024 has brought another heatwave, and many landlords are getting this message right now: I bought an air conditioner, the fitter is coming on Saturday. So what now? Below you will find the line between what a tenant can do alone and what needs to be agreed. This way of using a rented thing is described in Article 666 par. 1, which you will find in the <a href=\"https:\/\/dziennikustaw.gov.pl\/DU\/2024\/1061\" rel=\"nofollow\">consolidated text of the Civil Code<\/a>. What does it look like in practice? A portable air conditioner in a rental flat usually works with a hose put out through a tilted window and a fabric seal that comes off without leaving a trace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The line is crossed where permanent interference or a nuisance to others begins. Cutting a hole in the window frame or in the glass? That is already an alteration. The same goes for draining condensate onto the facade or a neighbour&#8217;s balcony. But before you reply to the tenant, check the lease, because it may contain its own bans or a duty to report larger equipment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_does_a_tenant_need_the_owners_consent_to_install_air_conditioning\"><\/span>When does a tenant need the owner&#8217;s consent to install air conditioning?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Whenever drilling through a wall, running pipes and cables, and an outdoor unit are involved. Such an installation is a change to the premises and the tenant needs consent for it. This follows from Article 667 par. 1 of the Civil Code: without the landlord&#8217;s approval, the tenant may not make changes that conflict with the lease or the intended purpose of the thing. Tenants sometimes rely on Article 684 of the Civil Code, which allows them to install lighting, gas, a telephone and similar devices in the premises, as long as this does not conflict with regulations or endanger safety. But does a split system with a condenser on the wall belong to that category? It is not obvious. That is why, in a dispute, it is better to ask a lawyer than to settle it in messages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do three things before Saturday:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Reply in writing that the installation needs to be agreed in advance.<\/li>\n<li>Ask for the work to be put on hold until a decision is made.<\/li>\n<li>Request a description of the installation: the model, the drilling point, the route of the pipes and cables, and the contractor&#8217;s details.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">I also recommend seeing the planned installation spot in person. Just keep in mind that <a href=\"https:\/\/tenanto.pl\/en\/landlord-entry-rented-apartment-when-allowed\/\">the owner&#8217;s entry to the flat<\/a> has its own rules, so arrange the date of the visit with the tenant in advance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Outdoor_unit_on_the_facade_whose_consent_is_also_needed\"><\/span>Outdoor unit on the facade: whose consent is also needed?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The facade is usually a common part of the building. So the consent of the flat owner alone may not be enough. And one more thing: it is the owner, not the tenant, who applies for the consent of the homeowners&#8217; association or housing cooperative, because the owner is the party dealing with the building manager. Check the following with the manager:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the building rules and earlier resolutions on air conditioners,<\/li>\n<li>designated places for outdoor units,<\/li>\n<li>rules for draining condensate,<\/li>\n<li>noise requirements.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And what if there is no approval, or the procedure takes longer than the summer? There are two options left. The first is a unit placed on <a href=\"https:\/\/tenanto.pl\/en\/balcony-rented-flat-barbecue-flowers-repairs-rules\/\">the balcony or loggia<\/a>, if the building rules allow it. The second - staying with portable equipment until the matter is cleared up.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Three_cooling_options_and_the_consents_they_require\"><\/span>Three cooling options and the consents they require<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The rule is simple: the greater the interference with walls and the facade, the more people have to agree. Here the wording of the lease and the rules in force in the building decide.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_should_the_owners_consent_to_air_conditioning_include\"><\/span>What should the owner&#8217;s consent to air conditioning include?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The consent should be in writing, ideally as an annex to the lease, and settle the costs, servicing and what happens to the unit when the tenancy ends. A short &#8220;ok&#8221; in a messaging app will not answer any of the questions that come up a year from now. Not one. In the document, cover:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>costs<\/strong> - who pays for the unit and the installation,<\/li>\n<li><strong>the contractor<\/strong> - a certified company and the exact drilling point,<\/li>\n<li><strong>servicing<\/strong> - who orders and pays for inspections and cleaning,<\/li>\n<li><strong>damage<\/strong> - liability for flooding or damage to the facade,<\/li>\n<li><strong>moving out<\/strong> - removal, leaving the unit behind or a buyout.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Also add a clause saying that your consent applies on condition that the homeowners&#8217; association or housing cooperative gives its approval. And what about day-to-day faults and maintenance? The easiest way to divide them is to follow the same rules that apply to <a href=\"https:\/\/tenanto.pl\/en\/minor-repairs-who-pays-rental-agreement\/\">minor repairs in a tenancy<\/a>. In Tenanto you can attach the signed annex as a document to the property, and record the installation and later servicing on the repairs board. That way the history of the unit does not get lost in an email inbox.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tenant_improvements_and_reimbursement_of_expenses_what_happens_to_the_air_conditioning_at_move-out\"><\/span>Tenant improvements and reimbursement of expenses: what happens to the air conditioning at move-out?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When the lease is silent, the landlord chooses: either keeps the improvement and pays its value as at the time of return, or demands that the previous condition be restored. This is what Article 676 of the Civil Code says. But it opens with the words &#8220;unless otherwise agreed&#8221;, so the parties can arrange it their own way. In my view, the simplest thing is to do it right away in the annex and pick one of the solutions: removal and sealing of the holes at the tenant&#8217;s expense, leaving the equipment with no settlement, or a buyout on agreed terms. This mechanism is covered in more detail in the article on <a href=\"https:\/\/tenanto.pl\/en\/renovation-rented-flat-who-pays-settling-costs\/\">settling renovation expenses<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All right, and what if the fitter showed up despite the lack of consent? Demand in writing that the changes be removed and document the condition of the wall with photos. In a dispute over costs or over whether the lease has been breached, consult a lawyer before you take further steps.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Air conditioning in a rented flat can work in the interest of both sides. The tenant gains comfort in hot weather, and the flat can become more attractive to future tenants because of it. There is one condition - the rules have to be put on paper before anyone starts drilling.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Frequently_asked_questions\"><\/span>Frequently asked questions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"schema-faq wp-block-yoast-faq-block\"><div class=\"schema-faq-section\" id=\"faq-question-1790879505655-0\"><strong class=\"schema-faq-question\">Can a tenant set up a portable air conditioner without the owner&#8217;s consent?<\/strong> <p class=\"schema-faq-answer\">Yes, as long as the unit does not interfere with the premises and the lease does not forbid it. A hose in a tilted window and a removable seal are ordinary use of the flat. Consent becomes necessary only when the tenant wants to cut a hole in the window or drain condensate outside the premises.<\/p> <\/div><div class=\"schema-faq-section\" id=\"faq-question-1790879505655-1\"><strong class=\"schema-faq-question\">Can the owner refuse consent to install air conditioning?<\/strong> <p class=\"schema-faq-answer\">Yes, because an installation that involves drilling is a change to the premises that requires the owner&#8217;s approval. But refusal is not the only option. The landlord can set conditions: name the contractor, the drilling point or the way things are settled at move-out. It is best to communicate the decision in writing.<\/p> <\/div><div class=\"schema-faq-section\" id=\"faq-question-1790879505655-2\"><strong class=\"schema-faq-question\">Who pays for removing the air conditioning after the tenancy ends?<\/strong> <p class=\"schema-faq-answer\">It depends on the annex, which is why it is better to settle this before installation. Without such arrangements, the landlord can demand that the previous condition be restored, meaning the tenant takes down the unit and seals the holes.
