Renting it by the night is already a hotel service, with separate obligations. So the difference does not end with the length of the stay: what changes is what the owner has to prepare and how much work is waiting for them. A student moves out in June 2026 and the studio in a university city would stand empty until September? Nightly rental means many guests and ongoing handling of every stay. The basis for the first option is Article 659 par. 1, which in the <a href=\"https:\/\/dziennikustaw.gov.pl\/DU\/2025\/1071\" rel=\"nofollow\">consolidated text of the Civil Code<\/a> allows a lease for a fixed or an indefinite term. And with nightly stays? Under the <a href=\"https:\/\/dziennikustaw.gov.pl\/DU\/2024\/1716\" rel=\"nofollow\">Interior Ministry regulation on fire protection<\/a>, premises where hotel services are provided must have detectors from 30 June 2026 (par. 2 sec. 4), and other flats from 1 January 2030 (par. 2 sec. 2). Since 30 June 2026 every flat let by the night has to be equipped before the first guest walks in.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second change is the <strong>EU rules on short-term rentals from 20 May 2026<\/strong>. Regulation (EU) 2024\/1028 concerns the collection and sharing of data, and according to the <a href=\"https:\/\/transition-pathways.europa.eu\/tourism\/legislation\/eu-regulation-data-collection-and-sharing-short-term-accommodation-rentals\" rel=\"nofollow\">description of the regulation on the European Commission website<\/a> it is meant to make this market more transparent; it covers platforms and the offers published on them, not hotels. What does this look like in practice in Poland? It is best to check with your municipality and on government websites before the listing goes online.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_should_you_rent_a_flat_to_for_the_summer_under_one_agreement\"><\/span>Who should you rent a flat to for the summer under one agreement?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A summer flat rental in a university city goes to people who come for a set period and know when they will leave. A tenant like this does not expect an extension, because the end of their stay is known in advance. Most often they are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>trainees and interns on summer programmes in companies,<\/li>\n<li>seasonal workers and staff posted to a temporary project,<\/li>\n<li>people renovating their own home,<\/li>\n<li>participants of summer courses and candidates looking for a place before October.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A seasonal lease for employees<\/strong> is sometimes signed with a company, which itself indicates who will live in the flat. The party to the agreement is then a business, which is why <a href=\"https:\/\/tenanto.pl\/en\/renting-apartment-to-company-for-employees\/\">renting a flat for employees<\/a> needs different clauses than a contract with a private individual. Floor area matters too. A small flat suits one person on a short stay well, and the <a href=\"https:\/\/tenanto.pl\/en\/studio-or-two-room-flat-which-is-easier-to-rent\/\">studio or two rooms<\/a> dilemma is usually settled in favour of the former in summer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_two-month_lease_agreement_how_do_you_end_it_before_September\"><\/span>A two-month lease agreement: how do you end it before September?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A fixed-term agreement ends when the date written in it passes. Provided the tenant actually hands the flat back and does not stay in it with the owner&#8217;s consent. Parting ways earlier is harder: Article 673 par. 3 of the Civil Code allows such a contract to be terminated only in the cases specified in it, so the grounds have to be written down in advance. And the trap sits in Article 674 of the Civil Code. Because continued use of the flat with the landlord&#8217;s consent after the end date means, in case of doubt, a lease for an indefinite term.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Set the end date with a margin for cleaning and viewings.<\/li>\n<li>Write the grounds for termination by each party into the agreement.<\/li>\n<li>Draw up a handover report on the day the lease ends.<\/li>\n<li>Do not silently agree to the tenant staying on, not even for a few days.<\/li>\n<li>Publish the listing for the academic year while it is still the summer break.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">A well-planned <a href=\"https:\/\/tenanto.pl\/en\/changing-tenants-without-a-vacant-month\/\">tenant change before September<\/a> therefore starts on the day the summer agreement is signed. Not in August. And when the tenant refuses to move out? Then you take the matter to a lawyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Which_form_of_summer_flat_rental_should_you_choose\"><\/span>Which form of summer flat rental should you choose?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A single summer agreement suits an owner who wants peace of mind and a certain date for the flat to be vacated. Nightly rental suits one who has time to look after guests and has met the new obligations. Four things decide the choice: how many hours a week you can give, how far away you live, whether the studio already has a <a href=\"https:\/\/tenanto.pl\/en\/carbon-monoxide-detector-rental-apartment-duty-deadlines\/\">carbon monoxide detector<\/a> and how much you care about having the flat free in September.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Overall, renting out a flat for the summer is a decision about the form, not just about the dates. The requirements in force since 2026, the amount of day-to-day work and whether the flat will be ready for a student in the autumn all depend on it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Frequently_asked_questions\"><\/span>Frequently asked questions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"schema-faq wp-block-yoast-faq-block\"><div class=\"schema-faq-section\" id=\"faq-question-1790979772622-0\"><strong class=\"schema-faq-question\">Does a two-month lease agreement have to be in writing?<\/strong> <p class=\"schema-faq-answer\">A written form is advisable, even for such a short period. The document is proof of the end date and the termination conditions, the two things that are easiest to argue about. Without it, it is hard to show that the parties agreed on the summer only.<\/p> <\/div><div class=\"schema-faq-section\" id=\"faq-question-1790979772622-1\"><strong class=\"schema-faq-question\">Do I already need a smoke detector for a summer lease?<\/strong> <p class=\"schema-faq-answer\">No. An ordinary lease has until 2030 for that, while premises with hotel services have been bound since summer 2026. The exact dates are given in the regulation cited above.<\/p> <\/div><div class=\"schema-faq-section\" id=\"faq-question-1790979772622-2\"><strong class=\"schema-faq-question\">What if the summer tenant stays in the flat after the end date?<\/strong> <p class=\"schema-faq-answer\">Consenting to further use of the flat carries the risk that, in case of doubt, the agreement will be treated as a lease for an indefinite term. That is what the Civil Code provides. So on the last day collect the keys and draw up the handover report instead of putting it off.
