Even though they do not live there. A student as the tenant is a completely different setup, because the debtor is then someone who usually has no steady income but is present on site. In August 2026, at the peak of lease signing before the academic year, this offer often comes from the mother of a future student: she will sign and she will pay. The student? Only a person using the flat. It is the father or mother who pays the rent and, once the lease ends, returns the flat in a condition that has not deteriorated, which follows from Article 675 paragraph 1 in the <a href=\"https:\/\/dziennikustaw.gov.pl\/DU\/2026\/795\" rel=\"nofollow\">consolidated Civil Code text<\/a>. The same act, in Article 688 superscript 2, states that handing the flat over for free use requires the landlord&#8217;s consent. There is an exception: a person to whom the tenant owes a maintenance obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice I would still name the student in the lease, by first name and surname, as the occupant. The owner then knows who actually holds the keys, and nobody argues later about consent to use the flat. It matters most when the lease covers a <a href=\"https:\/\/tenanto.pl\/en\/studio-or-two-room-flat-which-is-easier-to-rent\/\">studio for one person<\/a>, because there every extra occupant changes how the flat is used.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_the_student_liable_for_rent_when_the_parent_is_the_tenant\"><\/span>Is the student liable for rent when the parent is the tenant?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As a rule, no. The student is not a party to the lease, and that is that. Article 688 superscript 1 paragraph 1 of the Civil Code does provide that adults permanently living with the tenant are jointly and severally liable for the rent. But it excludes adult descendants who are supported by the tenant and cannot support themselves. And paragraph 2 limits that liability to the amounts due for the period of residence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision refers to people living together with the tenant. The parent does not stay in the flat, so it will not turn the student into a debtor. For the owner the matter is simple: payment demands and other claims go to the person who signed the lease. And if a dispute arises over who is liable for what? It is better to leave the assessment of a specific situation to a lawyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Parent as tenant, student as tenant or both in the lease - a comparison<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The three options differ mainly in who the debtor is and who the owner talks to day to day. A convenient setup. The weak point is the gap between who pays and who lives there: the tenant does not see the flat day to day and hears about defects second hand. The &#8220;parent as tenant or guarantor&#8221; dilemma is settled differently, because a guarantee is a separate arrangement in which the student remains the tenant. Oh, and one more thing: when the future occupant is under eighteen, the shape of the lease needs to be discussed with a lawyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_to_put_in_the_lease_when_the_student_lives_there_and_the_parent_pays\"><\/span>What to put in the lease when the student lives there and the parent pays?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You need to state who lives there, who reports defects and how the lease ends. Without that, the owner has a debtor in another city and an occupant with whom they formally have no relationship. Not great. Add to the lease:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>the occupant<\/strong> named by first name and surname,<\/li>\n<li>a ban on moving in further people without the landlord&#8217;s consent,<\/li>\n<li>a contact for defects and access to the flat, meaning the student&#8217;s phone number,<\/li>\n<li>the parent&#8217;s <strong>address for service<\/strong>, where letters and settlements are sent,<\/li>\n<li>a statement of who hands back the keys on moving out.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Let breakdowns be reported by whoever is on site, because only they can describe the problem or let a tradesperson in. In Tenanto this is what the <a href=\"https:\/\/tenanto.pl\/en\/tenant-portal-what-tenants-should-see\/\">tenant panel on the phone<\/a> is for, so the report goes straight to the owner. Talks about payments and changes to the terms still take place with the parent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_end_the_lease_when_the_student_moves_out_early\"><\/span>How to end the lease when the student moves out early?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The lease is terminated by the parent as the party. The student moving out does not end anything by itself. Typical scenarios are dropping out of university, moving to another city or the academic year ending before the date written in the contract. And in each of them the rent keeps running for as long as the lease formally lasts. The simplest route is <a href=\"https:\/\/tenanto.pl\/en\/ending-lease-by-mutual-agreement-poland\/\">terminating the lease by agreement<\/a>, signed by the parent, not by the child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Returning the flat in a condition that has not deteriorated is the tenant&#8217;s burden also when the damage happened in their absence. So the owner does not have to work out who flooded the floor or damaged the door. They settle with the person who signed. All in all, a lease signed by a parent is safe for the landlord, but on one condition: it clearly separates the roles of the one who pays and the one who lives there.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Frequently_asked_questions\"><\/span>Frequently asked questions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"schema-faq wp-block-yoast-faq-block\"><div class=\"schema-faq-section\" id=\"faq-question-1790979795817-0\"><strong class=\"schema-faq-question\">Who signs the lease with a student if the parent pays?<\/strong> <p class=\"schema-faq-answer\">The person who is to be the tenant signs. Transferring the rent alone does not make the parent a party, so if the owner wants the parent as a debtor, this has to follow from the wording of the document. Transfers from the mother&#8217;s account under a lease concluded with the student? They do not change who is liable for the obligations.<\/p> <\/div><div class=\"schema-faq-section\" id=\"faq-question-1790979795817-1\"><strong class=\"schema-faq-question\">Can a parent as the tenant let their child use the flat without the owner&#8217;s consent?<\/strong> <p class=\"schema-faq-answer\">The Civil Code requires the landlord&#8217;s consent to hand the flat over for free use, but exempts from this requirement a person to whom the tenant owes a maintenance obligation. Does that apply to a specific student? It depends on their situation. That is why it is safer to name them in the lease as the occupant and not rely on the exception alone.<\/p> <\/div><div class=\"schema-faq-section\" id=\"faq-question-1790979795817-2\"><strong class=\"schema-faq-question\">Is it better to put both the parent and the student in the lease?<\/strong> <p class=\"schema-faq-answer\">Two people on the tenant&#8217;s side mean two debtors for the owner and a direct relationship with the occupant. The price is paperwork: every change, annex or termination needs both signatures.
